Yes, but you must opt-in. According to Section 4.7.E of the regulations, owners can request a specific "Timeline Adjustment" that shifts the 2024 target to 2028 and eliminates the 2027 interim target entirely.

Warning: This does not delay the State of Colorado (Building Performance Colorado) requirements. You may be safe from City fines until 2028, but you could face State fines starting in 2027 if you ignore the 2026 performance period.
Per Section 3.3.A, all buildings over 25,000 sq. ft. are required to submit a third-party Data Verification Checklist with their 2025 or 2026 benchmarking report.

This is a mandatory audit of your inputs (square footage, meter data, property use types) signed by a Qualified Provider (PE/CEM). We provide this service to ensure your baseline is locked in correctly before penalties begin.
No. Section 5.3.B offers a specific "Residential Condominium Building Option." Instead of verifying every individual unit, the HOA can comply by upgrading the Common Areas only.

Requirements include:
  • 100% LED lighting in common spaces.
  • Occupancy sensors in common spaces.
  • Sourcing renewable energy (Solar) equal to 100% of the common area electricity usage.
Small buildings (5,000 - 24,999 sq. ft.) are on the "Prescriptive Track" (Lighting or Solar). Deadlines are strictly based on size (Section 5.2):

  • 15,000 - 25,000 sq. ft.: Was due Dec 31, 2025 (Overdue).
  • 10,000 - 15,000 sq. ft.: Due Dec 31, 2026.
  • 5,000 - 10,000 sq. ft.: Due Dec 31, 2027.
Yes. Section 4.7.B allows for an "Interim Compliance Hold" of 24 months if you can prove "Qualifying Financial Distress."
