Energy Benchmarking
Maryland’s statewide energy benchmarking law requires owners of large commercial, multifamily, and state-owned buildings to annually track their energy use and report results to the Maryland Department of the Environment (MDE) for public disclosure. The Building Energy Performance Standards (BEPS) were enacted in 2022 under the Climate Solutions Now Act.
Currently, all buildings greater than 35,000 square feet (excluding parking garages) are required to submit their annual benchmarking reports via ENERGY STAR Portfolio Manager by June 1, with the 2025 deadline extended to September 1.
Additionally, Montgomery County has its own energy benchmarking law that requires owners of buildings 25,000 square feet and larger to track and report annual energy use. Reports must be submitted each year to the County’s Department of Environmental Protection (DEP) by June 1.
Montgomery County’s Building Energy Performance Standards (BEPS), effective since 2022, sets long-term energy use intensity targets to help achieve net-zero emissions by 2035. Recent legislation passed in 2024 may exempt Montgomery County buildings from the State’s benchmarking requirements, making the County’s rules the primary standard for covered buildings within its jurisdiction.

Annual Reporting
Gather energy data from the local utilities; upload to EnergyStar Portfolio Manager; review property details; and report to the State on your behalf.
Verification
Provide third-party data verification services to fulfill the verification requirements. This can only be performed as a standalone service since the ordinance requires that the third-party verifier has no conflicts of interest with the data gathering activities.
